Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the-shift.dev (the “Site”) and your registration for or participation in events organized by The Shift (“The Shift”, “we”, “us”). By using the Site or registering, you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility

The Site and events are intended for professionals aged 16 or older. By registering you confirm that the information you provide is accurate and that you are authorized to provide it.

2. Registration & Attendance

• Submitting a registration or waitlist request is a request to attend; it does not guarantee a place. Admission is subject to review, capacity, and approval at our discretion.
• Invitation and referral links are for the intended recipient and may not be resold or used to misrepresent your eligibility.
• We may modify, reschedule, or cancel an event, and may decline or revoke admission, at our discretion.

3. Talk Submissions & Content

If you submit a talk or other content, you confirm that you own it or have the right to share it and that it does not infringe any third-party rights. You grant The Shift a non-exclusive, royalty-free license to use, reproduce, and display the submitted materials for the purpose of reviewing, promoting, and presenting the event. You retain ownership of your content.

4. Acceptable Use

You agree not to:

• Submit false, misleading, or unauthorized information;
• Interfere with, disrupt, or attempt to gain unauthorized access to the Site or its data;
• Use the Site or events for unlawful purposes or to harass other participants;
• Scrape, copy, or exploit the Site or attendee data without permission.

We may suspend or terminate access for anyone who violates these Terms or the event code of conduct.

5. Code of Conduct

Participants are expected to behave professionally and respectfully. Harassment, discrimination, or disruptive behavior may result in removal from an event without refund or compensation.

6. Intellectual Property

The Site, including its design, text, and branding, is owned by The Shift or its licensors and is protected by applicable intellectual property laws. Except for content you submit, you may not reproduce or reuse Site materials without prior written permission.

7. Third-Party Services & Links

The Site relies on third-party providers (e.g. hosting, email, and Google services) and may link to external sites. We are not responsible for the content or practices of third parties. Your use of Google-powered features is also subject to Google’s applicable terms.

8. Disclaimer of Warranties

The Site and events are provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted or error-free.

9. Limitation of Liability

To the maximum extent permitted by law, The Shift and its organizers shall not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of the Site or participation in any event. Our total liability for any claim shall not exceed any amount you paid to attend the relevant event.

10. Indemnification

You agree to indemnify and hold harmless The Shift and its organizers from any claims or liabilities arising out of your content, your use of the Site, or your violation of these Terms.

11. Privacy

Your use of the Site is also governed by our Privacy Policy, which describes how we handle personal information.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms. The effective date at the top of this page indicates when the Terms were last updated.

13. Governing Law

These Terms are governed by applicable law without regard to conflict-of-law principles. Any disputes shall be resolved through good-faith negotiation, and failing that, before the competent courts having jurisdiction over The Shift.
